Terms of Service

These Terms of Service ("Terms") govern your use of the Archanaut Galxy platform and related services (collectively, the "Service"), provided by Archanaut Pty Ltd (ABN 93 670 225 395) ("Archanaut", "we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

Archanaut Galxy is a NatHERS-accredited User Interface Protocol (UIP) software platform designed for existing home energy assessments in Australia. The Service provides:

• Cloud-based software interface for NatHERS energy assessments
• Automated data capture and validation tools
• Integration with CSIRO AccuRate calculation engine
• Geospatial data integration and property analysis
• Assessment workflow management and documentation
• Compliance reporting and audit trail generation

2. User Eligibility and Accounts

2.1 Professional Use: The Service is designed for use by NatHERS-accredited assessors and authorized energy assessment professionals. You represent that you have the necessary qualifications and accreditations to perform energy assessments.

2.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.

2.3 Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy.

3. Data Collection and Processing

3.1 Assessment Data: When using the Service, you will input property and building data including:

• Property addresses and location information
• Building characteristics (construction type, materials, dimensions)
• Photographs and visual documentation of building elements
• Energy performance measurements and calculations
• Assessment reports and compliance documentation

3.2 Automated Data Retrieval: The Service automatically retrieves data from authoritative sources including:

• NCC climate zone datasets
• Cadastral and property valuation records
• Aerial and satellite imagery
• Geospatial and mapping services

3.3 Data Storage: Assessment data is stored securely in Australian-based cloud infrastructure with:

• End-to-end encryption (TLS in transit, AES-256 at rest)
• 7-year data retention for compliance purposes
• Regular automated backups
• Role-based access controls

3.4 Data Ownership: You retain ownership of assessment data you create. We retain a license to use, store, and process this data to provide the Service and comply with NatHERS requirements.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Submit false, inaccurate, or misleading assessment data
• Attempt to circumvent NatHERS compliance requirements
• Use the Service to perform assessments outside your accreditation scope
• Reverse engineer, decompile, or attempt to extract source code
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without authorization
• Share your account credentials with unauthorized persons

5. NatHERS Compliance

5.1 UIP Adherence: The Service operates as a NatHERS-accredited User Interface Protocol (UIP) tool and adheres to all NatHERS requirements, including data accuracy tolerances and submission protocols.

5.2 Assessor Responsibility: While the Service provides automated suggestions and optimizations, you remain professionally responsible for:

• Verifying all automated data proposals
• Confirming accuracy of assessment inputs
• Ensuring compliance with NatHERS methodology
• Maintaining professional standards and accreditation requirements

5.3 Audit Trail: All assessments include comprehensive audit trails documenting data sources, automated proposals, assessor confirmations, and any overrides.

6. Intellectual Property

6.1 Our IP: The Service, including all software, algorithms, user interfaces, and documentation, is owned by Archanaut and protected by Australian and international intellectual property laws.

6.2 Your Content: You retain ownership of assessment data and reports you create. By using the Service, you grant us a license to use this data to provide and improve the Service.

7. Privacy and Data Protection

Our collection, use, and protection of personal information is governed by our Privacy Policy. The Service complies with:

• Australian Privacy Principles (APPs)
• Privacy Act 1988 (Cth)
• PSPF (Protective Security Policy Framework) requirements
• ISM (Information Security Manual) guidelines

8. Service Availability and Support

8.1 Availability: We strive to maintain high service availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice.

8.2 Updates: We may update the Service to maintain NatHERS compliance, improve functionality, or address security issues. Material changes will be communicated in advance.

9. Fees and Payment

Fees for the Service will be communicated separately through your subscription agreement. All fees are in Australian dollars (AUD) and exclude GST unless otherwise stated.

10. Limitation of Liability

10.1 Service Provided "As Is": The Service is provided on an "as is" and "as available" basis. We make no warranties regarding accuracy, reliability, or fitness for a particular purpose.

10.2 Professional Responsibility: You acknowledge that the Service is a tool to assist with assessments, and you remain professionally responsible for all assessment outputs and compliance with NatHERS requirements.

10.3 Liability Cap: To the maximum extent permitted by law, our total liability for any claims arising from the Service is limited to the fees paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Archanaut from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

12.1 By You: You may terminate your account at any time by contacting us. Assessment data will be retained for the required 7-year compliance period.

12.2 By Us: We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or lose required professional accreditations.

13. Changes to Terms

We may update these Terms to reflect changes in the Service, legal requirements, or NatHERS protocols. Material changes will be notified via email and posted on our website at least 30 days before taking effect.

14. Governing Law and Disputes

14.1 Governing Law: These Terms are governed by the laws of New South Wales, Australia.

14.2 Jurisdiction: You submit to the exclusive jurisdiction of the courts of New South Wales for resolution of any disputes.
