Archanaut Terms of Use

1. Definitions

2. Service Description
2.1 What ScanQ provides
ScanQ provides:
- LiDAR intake and data management — ingesting 3D scan data from assessor devices
- Pre-assessment QA checks — running assessment bundles through the Accurate Engine API to identify data issues and estimate energy performance before an official submission
- Certificate oversight workflow — reviewer queue, approval controls, and audit trail
- Certificate submission — submitting approved bundles to the Accurate Engine to obtain official NatHERS certificates
- Team and organisation management — user seats, roles, invites, domain verification
2.2 Pre-assessments — important distinction
A pre-assessment is a quality-assurance check only. It does not generate, issue, or constitute a NatHERS star rating certificate.
Pre-assessments allow assessors and reviewers to:
- Identify data errors before committing to a paid certificate submission
- Preview an indicative energy performance estimate
- Reduce re-submission costs caused by data quality issues
A pre-assessment result is not a compliant NatHERS certificate and must not be represented as one to clients, councils, or any regulatory authority. Only a completed certificate submission via the embedded Accurate Engine API produces a valid NatHERS certificate.
2.3 NatHERS compliance
ScanQ integrates with the Accurate Engine (operated by CSIRO/Accurate Pty Ltd) for NatHERS rating calculations. Archanaut does not warrant that any submission will receive a particular star rating or meet any specific compliance threshold. Compliance outcomes depend on the accuracy of the data provided by the assessor.
3. Subscription Plans and Billing
3.1 Billing reference
Fees, billing, and payment are governed by the Tenant's selected subscription, the Billing page in organisation settings, and any applicable quote or order form. Archanaut may update pricing, billing cadence, and payment methods from time to time. If there is any inconsistency, the Billing page and applicable quote or order form prevail.
Subscription-specific plan limits, credit bundles, and payment methods are described in the Billing page and supporting commercial documents rather than fixed in this Terms draft.
4. User Seats and Access
Each Subscription plan includes a maximum number of named User seats. Users beyond the plan limit are not permitted unless an Enterprise custom add-on has been agreed.
Tenants are responsible for managing User access. Sharing login credentials is not permitted. Archanaut reserves the right to suspend accounts where credential sharing is detected.
5. Fair Use and Rate Limits
5.1 Pre-assessment rate limits (all plans)
Pre-assessments consume Accurate Engine API capacity. The following limits apply:

Pre-assessments consumed beyond the plan monthly quota are not automatically processed. Basic and Pro plans may not purchase additional pre-assessment quota (the quota is a platform access feature, not a variable charge).
5.2 Enterprise fair use policy
The Enterprise plan is described as "unlimited pre-assessments" for typical professional use. This means Archanaut will not artificially cap usage for legitimate assessment workflows. However, the following conditions apply:
1. Monthly fair use threshold: 1,500 pre-assessments per Tenant. Usage consistently above 1,500/month across two or more consecutive months will trigger an account review. Archanaut may require the Tenant to move to a custom quote that reflects actual API costs.
2. Daily limit: 200 pre-assessments per Tenant. Requests exceeding 200 in a single calendar day (00:00–23:59 AEST) will be queued and processed the following day.
3. Hourly rate limit: 50 pre-assessments per Tenant. Requests exceeding 50 in any 60-minute window will receive HTTP 429 responses and should be retried with exponential backoff.
4. Automated or scripted bulk submission — using the platform for automated bulk pre-assessment generation (e.g., via scripted API calls, credential stuffing, or robotic process automation) without prior written agreement constitutes a violation of this policy and may result in immediate suspension.
5. Custom quote threshold: Enterprise Tenants with more than 25 users, or whose certificate submission volume consistently exceeds 100 certificates per month, will be contacted to negotiate custom pricing directly with Archanaut.
5.3 Rate limit enforcement
Rate limit violations result in:
- HTTP 429 responses for per-hour and per-day API limits
- Queuing for monthly quota overages (pre-assessments) rather than hard rejection
- Account review notification for sustained overages — Archanaut will contact the Tenant before any suspension
- Suspension only after failure to respond to two review notices within 14 days
5.4 Monitoring and audit
Archanaut monitors per-Tenant pre-assessment and certificate usage for billing accuracy and abuse prevention. Usage data is retained for 24 months and may be disclosed in the event of a billing dispute.
6. Acceptable Use
Tenants must not use ScanQ to:
- Submit false, fabricated, or materially inaccurate assessment data to the Accurate Engine
- Misrepresent pre-assessment results as official NatHERS certificates
- Circumvent user seat limits via credential sharing or automated account creation
- Create additional accounts to access the platform where a user's account has been suspended or disabled
- Attempt to circumvent any requirements to pay applicable fees or to render invoices in a manner designed to avoid payment
- Attempt to reverse-engineer, scrape, or exfiltrate data from the platform
- Interfere with the availability of the service for other users
- Use the platform for any purpose that violates Australian law or relevant state building codes
Archanaut reserves the right to suspend or terminate accounts found to be in breach of this section without notice where immediate action is required to protect the platform or other users.
7. Data and Privacy, user account information, and usage metrics. A separate Archanaut Privacy Policy governs personal data handling in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
Assessment data (LiDAR inputs, zone configurations, energy model parameters, photo evidence, video evidence, voice dictation recordings, and assessor labelling of photo or video elements during collection) is stored and backed up for a minimum of 7 years to support NatHERS compliance audit requirements.
Archanaut does not sell user data to third parties.
7A. NatHERS-Specific Obligations
This section applies only to use of ScanQ for NatHERS for Existing Homes assessments. It does not apply to other use cases of ScanQ outside the scope of the NatHERS for Existing Homes programme.
7A.1 Certificate integrity
Users must not alter a Home Energy Rating Certificate after it has been generated by the Accurate Engine.
7A.2 Client consent
Assessors performing NatHERS for Existing Homes assessments must inform their client that personal information will be collected (including name, address, and assessment data that may include photographs, videos, and building plans), obtain the client's consent for that collection, and record that consent in the platform.
7A.3 NatHERS Administrator authority
Archanaut has obligations to the NatHERS Administrator and applicable Assessor Accreditation Service Providers (AASPs). The NatHERS Administrator or an AASP may direct Archanaut to suspend, disable, terminate, or investigate a User's account. Where such a direction is given, Users must comply with any steps or actions communicated by Archanaut as directed by the NatHERS Administrator. Users may direct enquiries about such actions to the NatHERS Administrator directly.
Archanaut, the NatHERS Administrator, and AASPs will not be held liable for any loss or damage arising from an account being suspended, disabled, or terminated at the direction of the NatHERS Administrator or an AASP.
7A.4 NatHERS compliance documents
Users must comply with the NatHERS Technical Note and NatHERS Trade Mark Guidelines (as amended from time to time by the NatHERS Administrator), and must fully cooperate with any investigation or audit conducted by the NatHERS Administrator or persons appointed by the NatHERS Administrator.
7B. AI Training and Data Use
7B.1 Licence grant for AI training
By using ScanQ, you grant Archanaut a non-exclusive, royalty-free licence to use de-identified or aggregated assessment data (including inputs, outputs, and usage patterns) for the purpose of training, evaluating, and improving AI and machine learning models that power ScanQ features. This licence is limited to improving the quality and accuracy of the ScanQ service. Archanaut does not sell your data or any AI models trained using your data to third parties.
7B.2 Licence terms by subscription plan

Free tier users acknowledge that participation in AI training data contribution is a condition of free access to the platform.
Basic and Pro tier users may opt out of AI training data contribution at any time via account settings. Opting out does not affect access to any platform features.
Enterprise tier users are not subject to any AI training data contribution by default. Enterprise tenants wishing to contribute data for AI training may opt in via their account settings or Enterprise Agreement.
7B.3 Data handling for AI training
When data is used for AI training:
- Personal information is de-identified or aggregated before use in model training
- Client personal information collected by assessors is not used for AI training
- Trained models are used solely to improve ScanQ features and are not sold or licensed to third parties
- Data used for training is subject to the same security and retention standards described in these Terms and in the Archanaut Privacy Policy
ScanQ software, brand, and platform design are owned by Archanaut Pty Ltd. Tenants retain ownership of all assessment data they submit to the platform.
Tenants grant Archanaut a limited licence to process their data solely for the purpose of delivering the ScanQ service (including submission to the Accurate Engine and generation of NatHERS certificates).
9. Service Availability and SLAs
Standard plans (Free, Basic, Pro) are provided on a best-efforts basis with a target uptime of 99.5% measured monthly, excluding scheduled maintenance.
Enterprise plans include a minimum uptime SLA of 99.9% per month (excluding scheduled maintenance windows of which at least 48 hours notice will be provided). SLA credits are available for verified downtime breaches; details are set out in the Enterprise Service Agreement.
10. Limitation of Liability
Archanaut's liability to any Tenant under or in connection with these Terms is limited to the total subscription fees paid by that Tenant in the 12 months immediately preceding the event giving rise to the claim.
Archanaut is not liable for:
- Incorrect star ratings resulting from inaccurate data submitted by the Tenant
- Regulatory non-compliance resulting from reliance on pre-assessment results as if they were NatHERS certificates
- Loss of certificate credits due to subscription cancellation
- Delays in the Accurate Engine processing pipeline (operated by a third party)
11. Termination
Either party may terminate the subscription:
- Tenant: Cancel via the Billing settings page. Cancellation takes effect at the end of the current billing period. No refund is issued for the remaining period.
- Archanaut: May terminate for cause (breach of these Terms, non-payment, or regulatory requirement) with 14 days written notice, or immediately in cases of material breach.
On termination, Tenant data is retained for 90 days in read-only form, after which it may be permanently deleted (except compliance records required by law, which are retained per §7).
12. Changes to These Terms
Archanaut may update these Terms from time to time. Tenants will be notified by email at least 14 days before material changes take effect. On or after the effective date, users will be required to review and accept the updated Terms before accessing the platform. Continued use of the platform constitutes acceptance of the current Terms.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
